TERMS AND CONDITIONS
THESE TERMS AND CONDITIONS ARE VALID FOR ALL TOURS ORGANIZED BY SPIRIT OF DALMATIA.
THEY ARE SUBJECT TO CHANGE.
THESE TERMS AND CONDITIONS ARE NOT APPLICABLE FOR THE LOCAL DAY TOURS ON KORČULA AND PELJEŠAC, DUE TO SHORT TERM CHARACTER OF THOSE TOURS. THE TERMS FOR LOCAL DAY TOURS WILL BE AGREED UPON, EITHER IN WRITING BY EMAIL OR VERBALY WITH EACH CLIENT AT THE TIME OF CONCLUSION OF THE BOOKING.
THE MOST UPDATED AND PUBLISHED TERMS AND CONDITIONS WILL BE APPLICABLE AT THE TIME OF THE START OF YOUR TOUR.
PAYMENTS
When the down payment of 50% of the total tour cost is received by Spirit of Dalmatia booking is considered confirmed, herewith the client is considered to fully accept these Terms and Conditions.
The balance of the tour’s price (including any surcharges, if any and where applicable) should be received by us no less than 60 days prior to starting day of the tour (unless stated otherwise in the pro-forma invoice).
The definitive starting date and the amounts due per date will be shown on our proforma invoice.
We will send out payment reminders on due dates. In case that reminder has not been received by the client for any reason, we regretfully cannot be held responsible. If the payments are not duly received in full, we reserve the right to consider the booking as cancelled by the client. In such a case, the cancellation charges shown in the “Booking Cancellation” section will apply.
All amounts will be charged in EUR.
All reservation fees are to be paid directly to Spirit of Dalmatia’s as shown on the proforma invoice. Once the reservation fee is received, you will receive an official commercial invoice showing amounts prepaid and the balance with due payment date. When the invoice is paid in full, Spirit of Dalmatia will send you a fully-detailed travel plan for the tour you have booked.
Payments can be made only by wire transfer to the account shown on proforma and commercial invoices.
All tips/gratuities are included in the price.
After payment has been received in full, and no changes have been applied, we will charge no extra moneys for so-called hidden costs.
CANCELLATION POLICY & INSURANCE
When it comes to travel insurance, in case you don’t have any, we recommend you use GLOBAL RESCUE.

We encourage all travellers to purchase Travel insurance in order to protect their financial investment. Our experience shows that guests who purchase Travel Insurance, including trip cancellation, interruption, delay, baggage and personal effects loss, travel more assuredly.
Spirit of Dalmatia and our service providers adhere to the following cancellation policy for public/private tour departures. Fees per person:
- More than 121 days non-refundable administration fee of EUR 150 per person.
- 120 – 61 days 25% of the tour costs
- 60 – 31 days 50% of tour costs
- 30 or less days 100% of tour costs
For reservations cancelled within at least 61 days’ prior notice, we can keep your payment for any future booking you might make with us in the future – no questions asked! This credit will be valid for travel within one year of the date of cancellation.
COVID Policy for International Tours
For all international departures, should the borders not be open for travellers, our cancellation policy is flexible. For such cases, we will review the situation 60 days prior to departure to decide whether the tour can go ahead or not. Should the tour be cancelled due to COVID issues, all monies paid can be transferred to clients’ Travel Credit for possible future tour. On request, Spirit of Dalmatia shall remit all paid monies except the EUR 150 per person non-refundable fee.
Travel Credits
Travel Credit is non-transferable and non-refundable. It cannot be used as a payment for a deposit on another tour. Travel Credit should be used within one calendar year of the original departure date or it will be considered forfeited. Once a Travel Credit has been applied to the trip, the total amount paid is considered non-refundable.

Changes for Scheduled Departures
If the client’s request to change tour or the date of an existing reservation this request will be accommodated on the basis of availability. If this request is made within 90 days prior to departure, a minimum late change fee of 150,00 EUR per person will be applied. The client is responsible for any possible cancellation fees and similar incurred from the service providers.
Additionally, the guest must pay any increase in tour price. Only one date-change per reservation is permitted.
Changes for Private Tours
If the group requests changes to an existing private tour reservation it will be handled on a case-by-case basis. When Spirit of Dalmatia d.o.o. is in a position to accommodate changes, a minimum 150,00 EUR change fee per person will be applied. The client is responsible for any additional cancellation fees incurred from service providers. Additionally, the guests must pay any increase in tour price due to the change.
Itinerary Changes and Cancellations
Spirit of Dalmatia d.o.o. reserves the right to make any modifications to any tour. This includes the details of itineraries as they appear on www.spiritofdalmatia.com. However, Spirit of Dalmatia will make every effort to keep changes to a minimum. Spirit of Dalmatia retains the right to cancel, modify, or delay any tour at any time for any reason. In the event of a force majeure, which shall include, but not be limited to, an act of God, natural disaster, epidemic, pandemic, government-issued travel restriction or advisory impacting any portion of the tour, or for any other reason beyond the control of Spirit of Dalmatia. Spirit of Dalmatia will not be liable for any damage undergone by clients.
Spirit of Dalmatia may at any moment, cancel the tour completely or change the date of the tour. In the event of cancellation due to force majeure or otherwise, guests will receive a travel credit in the amount paid for the tour in question, to use for another Spirit of Dalmatia trip. Spirit of Dalmatia is not responsible for any personal expenses incurred due to changes in itineraries or tour cancellations, such as prepaid hotel accommodations or airline tickets. We strongly recommend doublechecking the trip with Spirit of Dalmatia before making any additional travel arrangements besides those arranged by Spirit of Dalmatia.
PACKAGE PRICE & CONTENTS
The client’s package content and price will be sent to the client in the final offer/ invoice, together with the detailed services as agreed upon. The final offer to the client is also a confirmation statement of his/hers selected services and is part of Spirit of Dalmatia’s contract with the client. The package price does not include services and costs on top of those provided by Spirit of Dalmatia, unless otherwise mutually agreed upon:
- Optional (non-obligatory/additional) excursions and visits
- Costs of obtaining and issuing visas, if any, and passports or other travel documents
- Food & drinks and other extra services
- Flight tickets and any costs that may occur due to flight schedule changes
All types of special services (such as last-minute single bedroom, special diet requests, etc.) shall be paid by the client themselves and must be ordered by the client when booking. If a client asks for a special service during the tour, the cost should be paid directly to the tour leader or the service provider, in the currency of the respective country.
The right to price increase and the right to cancellation due to price increase by service providers is reserved by Spirit of Dalmatia. Refunds and/or discounts shall be considered depending on the nature of the cancellation.
Prices of all tours are shown in EUR.
Spirit of Dalmatia may ask for an increase of the contracted price in case the following occurred after the contract was concluded:
- An unexpected and dramatic change of the exchange rate in relation to the one existing on the date of booking or program publication,
- An unexpected change of the transport costs (fuel, road toll, etc.),
- An unexpected change in hotels or service providers fees.
- Insufficient number of travellers booked for a specific tour.
Spirit of Dalmatia will inform clients of the changes in writing and if not possible verbally. A client may cancel the tour free of charge (except for the administration fee) if a price change exceeding 10% of the contracted rate occurs. Cancellation must be done in writing and within 48 hours after the receipt of the written notice. If the customer fails to cancel the tour in writing within the stated term, it shall be deemed that he/she agrees to the changed price. The published prices are based on Spirit of Dalmatia’s contracts with partners and they may differ somewhat to the prices stated at the provider’s premises or on their websites.
TRAVEL DOCUMENTS
No travel documents or vouchers will be issued by Spirit of Dalmatia, except for the final commercial invoice and the tour schedule. We will take care of all clients’ needs, as agreed when booked, from the moment the tour starts.
CATEGORIZATION AND DESCRIPTION OF SERVICES
The accommodation facilities offered in Spirit of Dalmatia programs are categorized according to the official categorization of the respective country valid at the moment of the publication of the program. Nourishment, modern conveniences, as well as other services offered by hotels/apartments are supervised by local tourist boards where the standards of accommodation and services differ and are not comparable. Spirit of Dalmatia shall not be responsible for any verbal or written information differing from the description of services and facilities in the published programs which were obtained from a third party
TRAVELLER’S CODE
By submitting your deposit and completing the client’s Traveller’s Profile, the client agrees to the following Traveller’s Code:
- I have chosen a trip that suits my abilities, level of fitness, and state of health.
- I do not have any physical conditions or disabilities that are a hazard to me or other travellers.
- I have a valid passport and all visas, permits, certificates, and vaccinations required for travel.
- I will read all pre-trip materials about clothing, medical requirements, and culture-specific etiquette.
- I will make sure to communicate any special requests at least 30 days prior to travel. This includes dietary restrictions, medical requirements, and room preferences. It goes without saying that Spirit of Dalmatia will make every effort to accommodate special requests but cannot guarantee they will be met in full.
- I will respect the laws and customs of countries visited
- I will follow environmental guidelines and regulations while on the trip in accordance with the tour leader’s/guide’s directions.
- I will respect the rights and privacy of the fellow travellers
- I understand that group travel inevitably involves compromise to accommodate the diverse desires, travel goals, personalities, and physical abilities of all group members. Spirit of Dalmatia tour leaders/guides may be required to improvise in good faith, use discretion, and/or make decisions based upon group consensus. These decisions may not always please each individual, but are intended to satisfy the majority desires of the group.
- I understand that Spirit of Dalmatia reserves the right to refuse service during a tour to anyone whose health or behaviour could impede the welfare or enjoyment of fellow travellers. Any individual may be asked to leave a trip if the leader determines that the person’s continuing participation may prove detrimental to the individual or the group.
- I understand that a road less travelled means that access to medical facilities and evacuation services may be limited.
- I understand the weather is out of Spirit of Dalmatia’s control.
- I will always wear safety equipment on any activity organized by Spirit of Dalmatia when required.
- I will not wear headphones when riding a bike.
- I will consume alcohol responsibly.
If you do not consent to these regulations, you risk dismissal from the tour and returning home at your own expense with no refund for the missed portion of the tour. Spirit of Dalmatia withholds the right to decline or cancel a reservation should the individual’s health or behaviour impede the welfare or enjoyment of fellow travellers.
LIABILITIES
Release of Liability
Spirit of Dalmatia is not liable for bodily injuries or property damages as a result of (but not limited to): physical exertion for which a client is not prepared; forces of nature (force majeure); collisions with bicycles, pedestrians, or automobiles; road conditions including, but not limited to, lack of hard shoulder and roadway surfaces affected by weather conditions; travel by plane, train, auto, boat, or other conveyance, or by bicycle, ski, horseback, foot, or other form of active or adventure travel; consumption of alcoholic beverages; civil unrest; terrorism; breakdown of equipment; high altitude; lack of, or limited access to, medical attention in remote locations, or the adequacy of medical attention once provided.
Guests who fail to provide a signed Release of Liability prior to departure will not be permitted to join the trip and standard cancellation policy will apply.
Limitations of Liability:
Spirit of Dalmatia is not liable for expenses including meals, transportation, or hotel costs that are not specified as included in the trip cost but may be required to get to or from a trip’s start or end. Sprit of Dalmatia reserves the right to make route and hotel modifications as necessary to improve the quality of a trip, or to accommodate the comfort and wellbeing of guests.
Lost Belongings:
Spirit of Dalmatia is not responsible for loss of passports, tickets, or other documents, or loss of or damage to luggage, personal property, or other passenger belongings. Spirit of Dalmatia will do all possible for the clients to solve the problems that might occur from the above-mentioned losses.
Miscellaneous:
Spirit of Dalmatia makes every effort to ensure the accuracy of our publications, but cannot be held responsible for typographical or printing errors, including printed published prices.
Spirit of Dalmatia recognizes that some clients may have severe food allergies. We make every effort to ensure that our suppliers are notified and prepared, but cannot guarantee that all requests will be accommodated.
Additionally, guests grant Spirit of Dalmatia permission to take photographs or film recordings of trips for promotional and commercial use, without remuneration. The guest agrees to assign all rights, title, and interest they may have in or to any media in which their name or likeness might be used to promote Spirit of Dalmatia. Guests agree that Spirit of Dalmatia may use any testimonials regarding services rendered for promotional and/or commercial purposes without any remuneration. Spirit of Dalmatia photography within this website is copyrighted by Spirit of Dalmatia and may not be reproduced without permission.
Spirit of Dalmatia does its utmost to comply with sustainable travel/tourism. However, we cannot always do so if the sustainable means are not available.
